01Eligibility & Medical Fitness

High-altitude mountaineering and adventure sports involve significant physical stress and inherent danger.

• Fitness Requirement: You must possess a reasonable level of physical fitness. For treks exceeding 3,000 metres (10,000 feet), you must submit a signed medical fitness certificate from a certified medical practitioner before the trek start date.
• Honest Disclosure: You agree to disclose all pre-existing medical conditions (e.g., asthma, cardiac issues, severe allergies) during booking. Misrepresentation or withholding critical health data grants us the right to cancel your booking immediately without a refund.
• Age Limit: Participants under 18 must have written parental or legal guardian consent.

02Bookings, Payments & Cancellations

• Permit Verification: Bookings are fully confirmed only after we receive your valid government ID / passport copies and secure the required forest or inner-line permits.
• Payment Gateways: All payments are processed securely via our integrated third-party partners. We are not responsible for transaction failures on their platforms.
• Cancellation Policy: Cancellations are governed by our Cancellation & Refund Policy. Please review it in full before booking.

03Mandatory Travel & Rescue Insurance

• Compulsory Coverage: For all high-altitude activities, you must secure a comprehensive travel insurance policy.
• Policy Requirements: Your insurance must explicitly cover high-altitude trekking / mountaineering up to the maximum altitude of your booked itinerary, emergency medical evacuation, helicopter rescue, and repatriation.
• Proof of Insurance: Digital copies of your policy must be submitted to us prior to trip departure.

04High-Altitude Risks & Liability Waiver

You explicitly acknowledge that high-altitude environments pose severe risks, including Acute Mountain Sickness (AMS), High Altitude Pulmonary Edema (HAPE), High Altitude Cerebral Edema (HACE), extreme weather, avalanches, rockfalls, and remote locations with limited medical infrastructure. Liability Waiver: By booking, you voluntarily assume all risks associated with the adventure activity. You agree to release, waive, and hold harmless Aarushi Adventures, its directors, trek leaders, and guides from any liability, claims, or expenses arising out of personal injury, illness, disability, death, or property damage incurred during the trip.

05On-Trek Authority & Safety Protocols

• Guide Discretion: Our trek leaders and mountain guides hold absolute authority on the field. Their decisions regarding route changes, pacing, or turning back due to bad weather, AMS symptoms, or safety hazards are final and binding.
• Non-Compliance: If a participant acts recklessly, endangers the team, or violates local environment / forest laws (see our Environmental & Leave No Trace Policy), the trek leader reserves the right to terminate their trip immediately. No refunds or compensation will be provided.

06Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of India. Any disputes arising out of your booking or website use shall be subject to the exclusive jurisdiction of the courts located in Chamba, Himachal Pradesh.
